thank you

i will upload a pic of the car when possable and sorry for losing another lexus :crybaby:
Balsca
Well, if you're fully comp on that vehicle, the insurance should pay out.

If you have 3rd party insurance, or you have Fully comp on another car and your driving the is200, then no monies/courtersy car for you.

3rd driver?

Do you have fully comp insurance or TPFT? If the latter then you won't get a bean for repair or write off.
ATEEK
i am on a fully comp insurance
ATEEK
however i am the 3rd driver! and with elephant.co.uk
kam05
3rd driver? Do you mean the car has fully comp insurance but you are a named driver on the policy which covers the IS200?

Apart from damaging a tree did you hit anything else? Other property, another car?

Did you report this accident to the police?
ATEEK
just hit a tree nothing els tree was not damaged i am the third named driver on the fully comp insurance
kam05
So the insurance policy that covers the IS200 is in someone elses name?
ATEEK
its on my mums name
kam05
Are you the main driver of the IS200 or your mum?
dazz32
Sorry for the accident and the loss of your car... :crybaby: another dead lexus....if you are the named driver on the policy then you should be covered under fully comp BUT if you ar NOT the named driver of the policy just an add on so to speak i dont think you will get a bean from the crash....i could be wrong.

Sounds like it could get a bit messy....
Asi
i think his mum is the main driver and he is a named driver but at that minute he was driving the car and crashed it so im guess they shuold pay out as its fully comp.
Mike_B
AIUI if you are named specifically on the policy then the full cover available applies to you as well - it would normally only be reduced to 'third party only' cover if you were covered under a 'any driver with the permission of the owner' type clause. That assumes, of course, that the policy was comprehensive! As to whether you get a courtesy car etc, that depends entirely on the wording of the policy.

You should go back to the scene as soon as possible and have a look at the road (assuming you can safely get close) - there may be oil or something on it. You don't really go into specifics of the accident but if there is diesel all over the road, or a carelessly positioned manhole cover, you may have a case against the local authority for failure to maintain the road in a safe condition.

However, since you were the only vehicle involved, no you won't get a flipping payout!

I assume it must have been a pretty big tree, if it's damaged the car enough to write it off but not sustain any damage itself?
ATEEK
yes i was a named driver on my mums policy

so we have lost evrything?
TigerFish
If you are a named driver on a fully comp policy, you should be covered.

The only potential sticky point I can see is if you are a named driver and your Mum the main driver only to save you money on insurance. i.e. it is your car but your Mum insures it with you as a named driver to save money. Insurers are getting pretty hot on that these days as it is fraud, so as long as that isn't the case, you should be fine.
kam05
so we have lost evrything?
You really need to check the small print of your insurance policy.
ATEEK
no its legit

my mums car - named on her its her car i only drive wen i ask her for the keys
Balsca
Well if your mother is insured fully comp and you are a named driver it shouldnt be a problem.
Let your insurance company know, if the car is a write off, then they should pay out how much they think they car is worth .

the best thing to do is, TELL THE INSURANCE YOUR MUM WAS DRIVING THE CAR AT THE TIME OF CRASH....SO YOUR EXCESS WILL BE CHEAPER TO PAY!

AND AS FOR THE ACCIDENT....YOU NEED TO PRETEND THERE WAS ANOTHER CAR COMING AT YOU AND YOU HAD TO MOVE OUT THE WAY WHICH CAUSED YOU TO CRASH INTO A TREE.

ITS THE ONLY WAY FORWARD IF YOU DONT WANT TO LOSE ANYTHING.

IT WAS AT NIGHT WASNT IT?

THE INSURANCE WILL PAY OUT AS THE SAME HAPPENED TO MY FRIEND.

Errr hold on, that is considered making a fraudulent claim and believe me insurance companies aren't stupid and it is also a criminal offence.
If that is what you would do yourself good luck to you but please do not advise other drivers to do the same.
Makes me wonder now why my premiums keep going up!

Some great advice there, mate!- Rez89 guide on how to commit insurance fraud.

If I'm ever driving in Wirral I hope I don't run into you.
knitware
I'm confused.

If I hit a tree in a car there are a few things that I would do. Call the police at the scene. Call the AA, or whichever you belonged to. Took pics of the site. Phone the insurance company.

If you call your insurance company they will advise you quicker than anyone here will. This is due to us not knowing your insurance policy details.

Hope this helps.
Good luck.
ormi
have you got any pics mate then we can tell you if its a gonner?and yes you should be covered, but can i stress one thing dont lie its their buisness and the insurers can smell blul shti a mile away.just tell them the truth lots of people have lost the rear of their rwd car in the rain and you wont be the last.

More than 50% insured drivers are commiting insurance fraud without knowing about it i.e. Not telling the actual milage they do..*ny optional extras, mods,
And the main one is people using their parents name as the poplicy holder....and the parents never drive the car!

If I was going to do insurance fraud I'd drive a car under my parents polciy but insurance companies start to charge more now!
My insurance is going to cost me £1800 on my own..which I am ready to pay!

Rez89

THe advise you gave is wrong.
People like you and your friends is why we all pay so much insurance.

Just phone them, explain to them what happened.
Say you lost control,
take pictures.

Be honest.
ibby
Pictures needed buddy,
bensyer
as ibby and knitware say, just ring them, police dnt need to no if no one else was involved at all,

phone the insurance if you are named then you are covered, they will only pay out if you can prove it was a accident and you should be able to ring them for info without making a claim

but remeber insurance company like to get out of paying for anything

defintly dont say it was anyone else driving do not lie they will catch you out,

i assume it was on a 60mph road or somthing to loose controll/?
russelllinn
As others have said, all you have to do is ring the insurance company and tell them the truth and go from there, they will tell you how they want to proceed and then if it is good news then so be it if they have other news then you could ask for some advice on how/if you can pursuade them otherwise on here!!

DO NOT take advice from people about making up stories you will more than likely get found out then it's a whole world of ****!!

I wish you all the best, will be worth posting some pics as there are some good people on here who may be able to help!

you do but he didn't, it was a tree he hit, it would only be things like cars, peopple, property, trafic lights, tele pols etc, other than that they only want to no if there is a obstruction in road etc

50%? im willing to put money on that being false also just because people get away with it, it diesnt mean you should be encouraging it, personally ive always had my own insurance in my own name as has my wife, my sister and my parents, with the minor exception of my mum who drove for ages on my dads policy but then they only had a single car and the insurance company new that.

Perhaps if you had taken out insurance in your own name you wouldnt be facing an 1800 quid bill now, at 23 I insured the lex for less than 500 quid with my missus on it who was only 18 and had be driving less than a year.

Encouraging people to break the law in anyway is conspiracy and just by writing these things could land you in the *****.

spank-it
Just a quick tip, insurance companies read forums to help them in cases, come up with evidence, and generally nosey around.

I would certainly not start a post about your crash, or about mods that are not declared, also pictures of crashes or tips on how to commit insurance fraud.

Thats just me though. I wish you all the luck with your claim and future insurance.

Sam
john99t-reg
very good point spank it, you never know who might work for elephant or the mib (no not will smith)on here, it was nice for your mum to put a private plate on her car that spells your name mate to say you're the 3rd driver, was that in exchange for the subs and amps you kindly put in for her and other little mods???? My mum loves a nice bit of jungle and drum and bass on the way to tesco. Also please don't think that an insurance company will not use private investigators to quiz your neighbours etc as to who actually drives the car. Oops
