I got an NIP yesterday, from the Metropolitan Police for the alleged offence of 47 in a 30 limit. What do you reckon I’ll get for it?

PS: you should also take account of the following. I have a receipt for the sale of the car in question (the Honda Accord I traded for my IS300 at Lexus Derby), dated 6 weeks prior to the alleged offence and I have a letter from a nice man at DVLA called Russell Trowbridge-Matthews, confirming that I had sent them the yellow part of the V5 telling them that I was no longer the keeper of the vehicle. That letter is also dated before the alleged offence.

I have had this twice on cars that I had traded in.

If you tell them who owned the car or who you had traded it in with and give them a photocopy then you never hear from them again.

Respond to the NIP saying you wish to challenge it, and include copies of the receipts you have. Then one of two things will happen, either you will never hear from them again, or they will take you to court and make themselves look foolish. Sounds like a simple snafu to me though.

If you simply write to them explaining the circumstances they will check up on the computer and see that the records have since changed on the ownership.worst case scenario they will contact you for photo copies

i had this on a car which i had sold and the new owner had hit someone and killed them then fled!! i had CID at my door but i had receipt of sale and that was good enouh and i never heard nothing about it again.

If you sold the vehicle, it is YOUR responsibility to inform the DVLA of the fact you no longer own the vehicle. If you haven't done that, technically you are still the owner of the vehicle. You could try contesting the case but it's not a guaranteed that you'll be successful because you are the owner of the vehicle and you cannot provide details of who you KNOW was driving the vehicle at the time. You may find a sympathetic magistrate but take into account court costs. You will likely get a fixed penalty of three points on your licence and a £60 fine. It depends though because under certain circumstances your local force may offer the option of attending a driver improvement course, paying a heavier fine (typically around £150) and not having the points on your licence.

In your case, because you've sent the yellow part of the V5 and had the letter back, that will be enough proof to prove you weren't driving the vehicle at the time and you'll not be prosecuted for the offence. Sensible move.

Protect your back because no one else will do it for you.

I am certainly not guilty, so the question is whether I hear nothing more or get loads of hassle. Anyway, the relevant paperwork went back (recorded delivery, naturally) so I shall await developments. Good to hear that the old Honda's still going well, though!

No you shouldn't get lods of hassle even if you hear anything. It's a clear cut case, you have proof you sent the V5 thing off, there is no argument to that. You'll be fine.

A NIP is simply that, a Notice of Intended Prosecution - you simply reply stating you were not driving the car - provide photocopies of the reciept and V5 sale information (DO NOT SEND ORIGINALS!) and the details of who you sold the car to.

You wont hear anything more.
