Yet Another Minor Problem That May Be About To Escalate

This issue is yet again with the dealer who sold me the car

After 9 months of owning my lexus, I have finally received a service book, I have been chasing it since the week I bought the car, in that time, the actual salesman who sold me the car has parted company with Adsheads, and more recently the Manager moved on too, so i've been passed from pillar to post to trainee to everybody, and the day I collected the service book, I was informed the previous owner was serving time at hger majesty's pleasure.

I bought the car having been told there was definitely a service history, although I knew adsheads hadn't at that time retrieved it so I would have to wait for it

In the meantime I went to Lexus myself and asked if they knew of the service history, although they couldn't tell me what had been done, they did tell me that it had been serviced by Lexus upto 40k (was 59k when I bought the car) and Adsheads told me they had serviced it at 50k

the book has been filled in saying there was a serviced at 41,433, and 49,611 by lexus solihull, all the writing is the same so I know the book hasn't been sent to any of the Lexus dealers who serviced the car, so Adsheads have either got the details over the phone or completely made them up

I suspect the latter given the discrepancy with the 50k service

If this is the case, can I legally require my money back from Adsheads for the car?

(I have seen another one I want instead, so i'll still be owning an IS)

Sorry mate, but its no to your Question mate, you will not get your money back :duh:

I suddenly get the feeling that when the time comes to sell the car, its not gonna be as easy as i'd like it to be, at least i've officially got the major 60k one on paper

I'm gonna give trading standards all the details of the transaction, as the length of time i've owned the car shouldn't be relevent, as Adsheads constantly assured me they would get the history for me, which took all 9 months, so what it boils down to, is if the service history is indeed inaccurate or, more blatantly, forged, then they have sold me the car having misled me

Either way, i'm going back to Lexus and Trading standards this week

It should be noted that to commit an offence, the description must be false to a material degree, e.g. has a significant impact on a purchaser’s ability to enjoy and/or use the goods/services, or a significant effect on their value. The Act is not intended to cover insignificant inaccuracies; ultimately only a court can decide what would constitute a material degree

A false service history is definitely somethin that would affect the re-sale value?

You should ring lexus solihull yourself on monday to see if it did have the 50k service,If false, then go back to Adsheads, tell them what you have found, then tell them what you are then going to do about it, see what thay have to say, then take things from there.

Legally when you bought the car was there mention in the advert or even verbally that the car had a full main dealer service history ?

If the answer is no, then I am afraid it is tough luck, and better luck next time

If the answer is yes then a contract was agreed based upon certain terms

The sellers terms (namely the selling company) were the description and staments made by their staff (immaterial if they have left died or been shot out of a cannon, the company is who your contract is with not the salesman)

Your contract was to agree to buy the car as described for the agreed sum

If their description was false, misleading or wrong then they have broken the contract

similarily if you failed to pay for the car it has failed

As the selling company have broken the contract by supplying goods differing substantially from the contract then you do have a right to cancel the contract and ask for your money back unless you receive a written assurance from a certifiable source e.g. Lexus GB or someone like the AA or RAC Technical services that all services had been completed on time and fully

You do have a right (should you choose it) and want to keep the car to demand a refund of the difference in value between a car with and without full dealer service history, as you have in fact paid for that and not received it

OR

If you have bought the car on finance then you also have a contract with the finance company to finance you the car as described, wrong or misleading description, wrong finance wrong contract

the salesman assured me verbally that there was service history, however not a full one as he was unsure, so I checked with Lexus, Lexus said it has had more than one service by themselves, last one at 40k, so I asked adsheads again about more recent services and they told me thy had done the 50k but couldn't tell me off the top of their head what work was carried out (needless to say, they haven't provided me with the 50k in writing, only a 49,xxx from Lexus Solihull that Lexus bolton don't even have on record)

which is what leaves me in doubt about the handwritten book they have finally provided detailing services from lexus that lexus themselves don't know about (or so it would seem)

I'll check my service details with Lexus, if they don't match, i'll pass on the details to trading standards, as their methods for co-operation are more persuasive than mine

yes, they sell anything from px bargains to £50k Rolls, and the px bargains are always a couple of grand to start, tis just their customer service is the worst i've ever known

I'll confirm how much of the service history was with Lexus, and challenge any discrepencies with Adsheads, with the help of trading standards, i'm willing to take it as far as I can to make sure i've not been sold a £6,500 lemon

took me a long while to save the cash to buy that car, I don't want to see that kind of money go down the toilet

If I were you I would ring the two Lexus dealers that supposedly carried out the two services. Confirm for sure if the car was with them and what was done. See if they will fax you confirmation if they were not then bring your evidence to the manager directly. Be nice and polite and document your discussion as you speak. Let him see you are noting what is being said. Ask what he suggests to solve the issue. Don't leave till you have an agreement in writing. If he tells you to take a jump then bring up "Trading Standards" etc. IT IS IMPORTANT YOU MAKE SURE YOU KEEP A COOL HEAD THROUGH IT ALL.

I have to ring each service centre for the details of the services, which i'm in the process of doing

the car was serviced in solihull, and birmingham, but unfortunately solihull no longer exists, and birmingham have said they will call me back

Update:

Lexus birmingham returned my call when I was at work, so I missed it, however, they did follow up with an email confirming that the 30k and 40k service in my book are correct, but no service after that, so i've emailed them back to ask if they can double check that there was definitely no full service at 49k from Solihull, and hopefully i'll have a reply by Thursday when I can go to my local trading standards office

after a few emails, 2 phone calls, a trip to Lexus Bolton , an email to Auto trader, and another trip to trading standards, I can give a positive update:

Adseads made up the mileage figures that they filled in my service book and completely falsified the 50k service (thats not the positive part)

Lexus have provided me with much more information on how much work has been done to the car, much to my satisfaction, they have given me service details, and other 'work carried out' info, on paper (not in the service book, but Lexus paper is good enuff for me given what I started out with)

with this information from Lexus, it seems my car is officially in the excellent mechanical condition I had hoped, and having it all on paper has given me extra piece of mind :D

As for the false 50k details and the made up mileages quoted by Adsheads from the other services, this is in the hands of trading standards

I, am one happy chappy, finally :D

Got there in the end, lol, I may go into Adsheads and question the incorrect details anyway, just to stick the final boot in, and let them know Trading Standards will be keeping their eyes on them for the near future,

Auto trader sent me a copy of the ad for the car, it never actually mentioned the service history unfortunately, so as far as that goes, it was always my word against their's, but they did however say there was one, and they then provided a false one,

i'm just happy i've not bought the lemon I thought I may have, just pieves me how I've sent a few emails 2 lexus, spoken to them on the phone twice, and acquired any remaining details on paper, in the space of a week, when Lexus took 8 months to fake it ?!

Clearly Adsheads of Manchester RD Westhoughton don't care at all about aftersales service

Just thought i'd mention this, My brother was watching Rogue traders the other day, which featured a Clutch and Brake Specialists in Bolton, who have been doing unnecessary work to overcharge, and shoddy repairs, and it just happened to be S&D, which is part of Adsheads of westhoughton, where I bought my car, lol

(I might add that my car has passed its MOT having had the ball joints replaced, and is absolutely fine, despite where I bought it from :D )
