  1. Thanks The Ed. dont worry abotu dave1 i dont think theres been a single post i have been involved in where he has doen anything but disagreed. As for being misled by my barister i very much doubt she or her solisiter husband would be in work if they didnt know the law. The law is still very clear and if dave1 was correct my barister friend would be fighting my case in court against the bank for taking it from me in the first place, instead of telling me to keep hold of the money. Just to add to the story i had a letter 2 days ago (waiting when i got back of holiday, Early as we was camping in wales and got out before the weather hit) The bank have explain the diffrent sums for the 2 lots of second payments. The diffrence in the "extra" payment and what was actually owed is "additional" compensation for dragging their feet with the claim. So basically yes i have been sent one payment twice. Diffrent ammounts because they wanted to give me even more money. Firstly, the bank really are not going to look me up on the internet just on the off chance i have posted something some where about the overpayment. Last time i checked theres nothing on this website that links to me, theres also nothing on facebook, that without breaching privacy laws, links to me either. Secondy, when they ask if they have made a mistake i will check and get back to them eventually returning the fund. Unless the bank can proove infront of a judge that i had the money knew all about it and then refused to return it there wont be a court case. As i dont intend to keep it once asked for it theres no case to answer. I think everyone can probably quote/refrance a case where the banks messed up. One recently in my area, the cash machine/hole in the wall was paying out double the amount requested. There was a queue around the block once the word got out. The police heard what was going on and stood gaurd at the machine so no one else used it. The bank, even with cctv footage and proof of who made what withdrawl at what times, didnt follow anyone up didnt chase any money back. So in short the banks have been ripping people of for years they have made an over payment to me which according to a barister i can keep until its return is requested. If for some strange quirk of law, i end up in court i will have free legal council at least from a barister who has the understanding no law has been broken.
  2. Having presonally fitted a tow bar to a is200 sport, they fit. I out one on an early sport last year. the guy tows a jet ski with it regulaly and a twin axle trailer on occasion. It was a witter tow bar if your interested in the brand to check their web site.

  4. To be brutally honest, because nobody on here knows you, none of them in reality could give a f*ck if you got done for it or not. Pleading ignorance of knowing the money was there no longer stands, as there is now a cached trail of you admitting it is not yours on facebook and LOC and probably other places too (and more importantly google and other search engines). So whilst it is probably worth risking it for a biscuit, I would be more concerned about your judicial welfare if I actually knew you. The law is pretty set. I paid the banks money i didnt need to (ppi) when i asked for it back they made me wait for 5 months before returning it. The banks have now paid me money they didnt need to pay me so i will make them ask for it. The bank didnt contact me saying do i want my money back so why should i contact them saying do you want yours back. its pretty simple. Yes theres a trail on facebook and here saying i have the money but it will only go to court if the banks ask for it back and i say "i dont have it" there wont be a court case,as when they ask for it they can have it so the trail of me saying i have it makes no diffrence. Even if i did put it into an isa i have sufficiant funds to cover it anyway,which is a point i mentioned to my barister who claims that wouldnt matter as my other funds were set aside for a spacific perpouse. I did get one response from a "friend" on facebook who had 700 quid stuck in her account for no apparent reason. it just appeared. She contacted her bank straight away who asked her to draw the cash and hand it in. The week later she has 100 quid stuck in her account and was told it was compensation for her inconveniance. Morally i should contact them first thing wednesday morning, legally according to a barister i only have to give it back when and if they ask. As long as i do return it when asked there wont be a case to answer. A court case really doesnt bother me as they cant just stand me in court as i havnt refused to return it they havnt asked me to yet. besides the cost of the court case would be much larger then the amount to recover,
  5. Another interesting point as come to light now. Everyone on here has said keep it dont tell them. Which to be honest is my plan. If they ask for it they can have it back. My "friends" on facebook all say i should return it immediatly lol. You guys on here i dont know me and are not involved one way or another so belileve you have given an honest opinion of what you think. Is it just me or does it sound like my "friends" on facebook are a tad jellous and dont want me to have it a second longer than possible. Just to show how much i have looked into it, My barrister has said i can legally put it in a long term now accessable i.s.a and keep it for 5 years or more. If i believe its been given to me legally then why wouldnt i put it away. The bank then would have to wait until the i.s.a matures to get their money back and i get to keep the interest. I would have course have to do through the courts and proove where the money was and that i couldnt get it back, would be real fun to put it in an i,s,a with my bank technically i have given it them back ha ha
  6. I cant advertise my services but can tell you all for sure and for certain they are way cheaper than what you have been quoted. I paid less than £60 for mine but then i get a massive discount from my supplier. Its not a genuine one as its a bosch one i have on. its been on 2 years and 20,000 miles certainly does the job. The part numbers are diffrent but are affectively the same part. If your into a bit of d.i.y companies now make a universal sensor with no socket on the end of the wiring. SImply chop and solder your old one on. The universal ones are much cheaper.

  8. I recently had a succesfull ppi claim against my bank. The ammount is irrelavant to the story. Anyway it was a two part claim as i had two loans over the years. The bank sent me a letter detailing the two parts and a total owed. The first part of the claim was paid direct into my bank account. Two weeks later the second part haddnt come so i phoned my bank and was told they would sort it asap. With in a few days a checque arrived which i paid into my bank and concidered the matter finished. I have just checked my bank account and found a third payment which has gone direct into my bank which is diffrent to either of the amounts due. I have contacted my barrister friend who says legally i dont have to do anything. Its their mistake and they took it from me dis honestly in the first place so enjoy the interest but be prepared to give it back should they spot their mistake. My question, should i contact my bank first thing wednesday morning? (being the bank holiday) or do nothing and wait for them to contact me. Added to the story i go away on holiday thursday for a couple of weeks so the money will sit in my account for atleast 2 weeks. I welcome your thoughts. what would you do ?
  9. As an mot tester i can tell people that the items mentioned are now testable but not yet failable. Which you must admit is stupid. Whats the point of testing an item if the result of that test make no diffrence. The date these items should have been failable has come and gone and there has been no date set to end this "bedding in period" as voso have called it. As mentioned a warning light should function correctly which means it should come on then go out after a pre determind amount of time. If the light doesnt work this means the system is faulty. If the light comes on and stays on this means the system is faulty. The whole point of a warning light is to warn you of faulty system. E.G If your oil light doens work how are you going to know if you have no oil pressure. Your oil light wont be in the test by the way thats purely an example. There is a number of other items that are now in the test. Dust covers for instance on ball joints. Torn ones now are a fail even if the joint is still very serviceable. I havnt yet found a supplier for dust covers so am currently changing compleate bottom arms on some cars for the sake of a 10 pence rubber cover. I have started to remove and save dust covers from worn joints i remove to use them to replace split covers on good joints. The average Audi has 3 front tie rods. All 3 are made from ally and are expensive to buy. The warnign lights are not the only thing thats going to force drivers of old cars of the road simple 10 pence dust covers could finish a car of.
  10. personally i dont want the side skirts or the rear bumper as i have a twin tail pipe system and dont like the side skirts. so how about making 5 front bumpers ! is that do able???? over a grand for a full kit that i only want one piece of making it very steep price just for a bumper, and i cantg see anyone buying the remainder of the kit off me.
  11. Just a couple of questions and an offer. If the company making these kits are doing it at your request does that mean then you get the moulds are even get a comision every time the company use the moulds? . With the number of Is200/altezza on the road around the world the right to a spacific body kit could be worth a hell of a lot of money. Is the plan to get the company to make the moulds then let them have the world wide rights to the sale of all ferther body kits ?. Also once the moulds are made why can the company then not create single items of the kit i.e single bumper or skirt kit. Its would seem silly to buy the complete kit damage a bumper then have to create a complete kit again. I personally only want the front bumper, as i know a great body shop i could buy the bumper of ebay and have my body shop graft it up for me no problem and certainly for less than the cost of the full kit. So my offer , I am willing to throw some money into the pot providing this kit does meterialise. If the person "investigating " the kit wants to get intouch with me via a message to tell me exactly where the process is upto thats fine.
  12. Not to sure on side skirts and rear end, but put me down as a definate for the front end. Dont care what it looks like from what car thats and awesoem front end. Only problem is when its on i will have to retake my profile picture ha ha
  13. As you can see from my picture Lewis mine just has a filter on it. The pipe is a breather/vent pipe and as long as its not blocked you will see no ill affects. Mine has been the way it is for about 12 months now. It should be attached to the intake system just to actually "pull" the vapour out of the block. Like i said mine has never showed any ill effects and as its the highest point on the engine no oil comes out anyway. I,m not saying its correct (just before the purist jump on me ) but its not wrong either. The pipe is ment to allow the engine to breathe as long as its not blocked you wont have any ill effects.
  14. as you only paid £500 for the car i would say its worth repairing. they normally change hands for £1500 so you have a grand to play with.....
  15. will cost more than a head gasket job as the head still has to come of the block so its a head gasket job + new valves
  16. Thats mine complete with engine cover. noticable changes except for more noise at 4250 revs upwards. no loss or gain of power or mpg figures. My IAT sensor is fitted in the same place as the pictures but i pulled the wiring out of the loom a little and didnt have to extend it at all.
  17. Manufacturers have diffrent spec vehicle for diffrent countries. I wouldnt be suprised if you didnt have an amp. Lets face it if you cant find it ,its not there you havnt got one. if you have all the other sport add ons why worry about it. alloy pedals and scuff trims are cosmetic they dont change the way the car drives.
  18. if you have no compression then you have broken your cam belt plain and simple. Check the belt. it may have stripped a couple of teeth. It will still turn the cams but not at the right time. If you have no compression dont waste any more money checking or changing anything else. No compression can only be caused my 2 things big hole in your pistons or bent valves. unless you over heated it you havnt got a hole in your pistons and certainly not all 6. your vavle timing is out plain and simple. If the cams are turning then the valves are opening,if they are bent they wont close and you wont get compression simple as that .
  19. where in manchester are you fella ?? theres a load of jap car breakers in failsworth area. theres a couple in oldham as well i certain one or more will have an is in. i have a number for one of them 01616272961. theres a yard right behind what used to be carpet world on oldham road failworth failing that theres another one about 300 yards ferther up towards oldham behind the body shop on the main road. sorry i cant be more help with the road names. the only other thing that may help is they are all run by muslim lads so should be open easter sunday, although they all shut for an hour around mid day!
  20. As a mechanic/ mot tester of over 22 years (i have done 22 years with my current employer) i have never had a problem with an oil filter of any make. If the seal is the right size and the filter is tight it wont leak. You cant buy non O.E spec parts in this country unless you buy them from under a counter some where. Some times what happens is the old oil seal sticks to the block and the new filter seal then has no chance of fitting correctly as its mounted to the old seal not the block. The current one on my Lexus is Fram,which is German. I have,in the past, used Puralator filters which probably no one has heard of. They where at the time the biggest selling filter in the states. You shouldnt have oil on your under tray, if my lads removed a filter leaving the tray on they would be in trouble. On the other hand i was behind a bus the other day and read the advert for one of these cheap deals , the small print said "there will be an extra charge if engine cover needs to be removed. Dont be sucked in people by these cheap deals my normal price for oil and filter is abotu £36 thats without frills and gimmicks just the normal price. I recently found,whilst looking for a locking wheel nut key, a wod of reciepts from national tyres. The customer had had brakes tyres tracking and a few other bits done. he was my customer but had been sucked into their 25% of deals. I beat every single one of their prices without even trying to again no gimmicks no special mates rates no 25% off this month only. Their prices are inflated then discounts given and even then their not cheap !
  21. i have checked the rules on this one and it would appear section 59 is pretty well much a public order offence, with a car. If you bother to read it (very complicated bit of law with a sub section on a sub section) its really difficult to find a situation where it couldnt be applied. Failing to to indicate could be seen as "annoying" to other road users, and therefore subject to a section 59 warning. As there is no need for evidence to issue the warning theres nothing to argue. The other thing that seems stupid is that the warning is against the car not the driver, as i have 6 cars 3 of which have a "cherished" number plate would they be able to seize one of my other cars if i swapped number plates between cars (legally swapped of course). Also as the warnign is against the car i could sell it and the new owner would be subject to the warning !!!
  22. I have just been out in my show car, a mint 1992 e36 BWM Schniter.. Anyway i had my show plates on it as i forgot to remove them from the last show, next show on sunday and as its been stood for 3 weeks was just running it out to check for sticky brakes and so on before sunday. I was pulled over by the police and instantly thought bloody plates, so i offered to change them there and then as they only clip into the holders and i had the street legal ones in the boot. The copper told me he wasnt interested in the plates he was havign me for speeding. Now honestly i couldnt tell you how fast i was driving i may well have been over the limit. The copper told me i must have been way over the limit as he had to do 70 to catch up. He told me he was issuing a section 59 on the car. Basicly the next time the car is seen driving badly the car will be seized. NO trai,l NO evidance, NO proof anything illegal had actually happened just the say so of the copper. Ferther more it doesnt matter if it was me driving it at the time, so my wife could be driign next week the copper decided its been driven "anti socially" and kick her out of it and seize the car. This has to be the worse most stupid law there is. I uunderstand gettign boy racers of the street but to seize a car purely on the say so of a copper has to be wrong!!!
  23. I stand by what i say also. section 6.3 of the testers manuel clearly states " testers are not required to required to physically measure the spacing" fail only if obviously mis spaced. As for a missing petrol cap key its not that its a fail item, its reason to not test the car in the first place. i can refuse to test on the grounds i cannot check your petrol cap seal. I can also refuse to test your car on the basis you have just done your shopping and its in the boot so i cant check your boot floor for corrosion. It happens alot where people forget to leave the key. Can you imagine your mot ran out yesturday its the first test as its only 3 years old, you book in for test, i refuse to test it because of some petty thing missing key dirty lights/number plates shopping in the boot. Buy the time you have nipped home emptied your boot ,got your keys ,washed your car ( take your pick which). you return to the test station to be told " you have missed your slot and i am now busy until next week. sorry. your mot is out technically you cant drive home as you wasnt booked in for test as you have already been home once from the appointment you had. So your choices, do with out your car until i can get round to doing it, or pay for it to be lifted and delivered to your house until i can get round to doing it or someone else can. Its very easy to say yes thats the rules but you are actually faced with it its not so easy. Oh and dont take the testers manuel as set in stone either the manuel is currently full of faults. Theres lots of items that are listed as testable but are currently not on the mot computer system. I have to test them but cannot fail them even though the manuel says its a fail. If they are faulty theres no way of actually failing them so why test them in the first place??. I will be giving you a pass certificate knowing the car should fail. The current manuel allows me test and not fail failable items So again i stand by my post i wont fail a petty item (unless the car fails on other items as well), if i fail cars for petty stuff i wont have many customers and will soon enough be out of work. like op said they have been on the car a while with no problems if the police are not bothered why should i be its not like its causign anyone a problem or harm is it? If you want to be a stickler for the rules i bet i can fail any car that comes through the door i can always find a way to interprite the way the manuel is written. Personally i prefer to give the benefit to the vehicle owner a double space in a plate is reason to fail but then again as i dont have to physically measure it, it looked ok to me and would pass. After all thats all thats included in my "remit" i judge each item thats testable and make a judgement as to its ability to do the job its designed to do.
  24. Its a pain in the butt job on some models. I cant quote on your model exactly as i dont know the car. To gain access to the mechanism you have to remove the interior panel. If the panel is fitted in such a way it cant be removed with the door closed then damage to the panel may occur. It could be a new interior panel they are quoting for should they damage it, but even then i dotn see 2k to fix it. Theres a particular model of car (bmw)that has the same problem with the boot lid locking and not opening. The back seats do not fold down so there is no access into the boot to get at the mechanism. I have found a way to drill a hole behind the numberplate that allows just enough room to,with a home made tool , release the boot latch. The hole then gets filled with a grommit and number plate refitted. know one knows its been done. The editor!! i recently had the same problem with the same door on a c class mercedes and really didnt want to damage the interior door panel to gain access. Took me ages to get it off without damaging it. That was just a loose wiring terminal as well.
  25. Your 1st sentence and your last sentence on this thread seem somewhat contradictory. You either test under the manual rules or you don't. If you regard something as petty it should still be a fail if, as you say, you test to the manual! Its ment that i test to the manuels "rules" and not the law. The standards and limitations are diffrent . I cant test to the "design and use" as this has nothing to do with the mot. But failing petty stuff isnt me. As i said incorrect spacing is a fail and if the car was to fail on another item then i would fail the plate as well, as it is actually a fail. I wouldnt fail just a petty spacing fault. Would you be happy if i said "here you go mate your car is ok it but i failed it because your number plates are dirty?? thats a fail item. Would you be happy leaving your car with me while you went to work only to return and find i havnt even tested it because you didnt leave the key for your locking petrol cap. Technically your very correct but theres alot of things within the mot test Like number plate spacing that is pretty petty. If the plate is readable then it should pass afterall thats all a number plate should be, correct numbers/letters and readable. Does it need to be anything else to do its job as a plate? "fil 4362" or "fil 4362" Well worth failing a car for that extra space in the second plate, it makes the plate almost unreadable doesnt it.? After all thats exactly what this thread is about a double space in the plate.
