Fair enough. Id fight it even with that and prob get a split cost deal at the minimum.

I don't have that exclusion in my paperwork. From what I can gather, there are two approved used warranties, a manufacturer's equivalent (almost like, but not the same as, that provided with a new car) and the 5+ for older vehicles. Although my car was six years old when I bought it in July I have the former. The two year extension which starts when that runs out is also the former.
