In-car telematics

I came across an article from 2014 that said apparently new EU regulations will require all cars to come with telematics that will be able to provide the same information that black box provides to insurance. But the article makes it sound like insurers can access this info without your consent. But do you not need to consent to being monitored? Do All new cars have this now?

These black box rulings never became law, because EU legislators could not agree on the numerous exemptions required because of constraints related to car design, mass characteristics and weight distribution. Instead, legislators were looking at alternatives such as intelligent speed assistance and monitoring, driver drowsiness monitoring and others.

At any rate, should they ever become law, they will not apply to the UK after January 31st... but there is nothing to stop the UK from adopting similar rules.
