update, after my first letter to them i got this response: As you can its not the original, and has no signature or dates on it, so with some advise from the consumer forum, i sent them this: FORMAL REQUEST FOR INFORMATION CPR part 31.16 Date 14/05/2009 Dear Sir/Madam Re:− Account/Reference Number I write with regards to the above account with your organisation. I respectfully request that you provide me by return a copy of the credit agreement which bears my signature. I require this as I have reason to believe that there may be discrepancies within the agreement which may leave it improperly executed. Obviously if the agreement is improperly executed I would be entitled to ask the court to consider the agreement and make a declaration of the rights of parties to the agreement. I must stress this request is NOT made pursuant to section 78 Consumer Credit Act 1974 but is made pursuant to the Civil Procedure Rules ( Pre action protocols and Part 31.16) and therefore unsigned copy will not suffice, only a copy of the original contract in its unaltered form will suffice in these circumstances Please confirm if you still hold a copy of my signed agreement and that you will provide me with this document. I do not view this as an unreasonable request given that by supplying the document which I have asked for it will allow me to assess if my case has merit and will help to resolve matters possibly without the need to involve the court and will undoubtedly save costs on both sides I look forward to your reply and would ask for a response by 4pm on 04/06/09. yh i wrote that and told them that over the phone when discussing the delivery of the item, but i think its makes no difference as you are entitled to request a refund in 20 days i think

this is the thing but did you leave him with positive feedback for the item you recieved? the buyer in my case did leave positive feedback, then to only turn round and say its faulty and it does not switch on

yh it would not let me as my account is in dispute. I rang both HSBC and TSB, HSBC cancelled all authorsation for Paypal, and TSB cancelled aswell, only thing is TSB stated there would not permantly do it, as the direct debit mandate is between mine and paypal, so paypal have every right to resubmit the mandate.HSBC did not mention this. So if paypal request money both banks will refuse, and paypal have the right to resubmit the mandate without my authorisation, which then takes 14 days to set up, but atleast this delays the refund if it all goes pear shaped.

right, this is getting very annoying, paypal had stated that that there would refund the money as soon as the item has been confirmed delivered, ethier by me on the website of by Paypal themself. Today I checked roymails website with ref number: DW788356181GB if you check it, it states confirmed delivery by there office today. Well guess what no sign of it, asked all family members nothing at all. Rang royal mail as the signature will not appear, and there stated the surname signature was just a scribble starting with "Ba" and the place where you print your name its just "Ba", no one in family is even close to that, and none of the neighbours I know has such a signature. Fourtunally, I rang paypal explained to the nice english lady (not indian lol who cants seem to understand) and she was very nice and professional and stated if this is case, the refund will not take place, even though royal mail have confirmed it. She said she will email the buyer and get him to confirm to them the address it was sent and email me, to let me know to call them to discuss further. this is getting from bad to worse.... I am very tempted to ring both of my banks on my paypal account, and ask them whether there can completly restrict 100% all ingoing and outgoings to paypal. Is this possible?

I havent had the chance to take it back. Im going to look at it my self tomorrow, and give a very good cleanr, and if no difference ill take it back will let you know

yh been doing alot of research and according to the sale of good act 1979, as Steve has mentioned, its the retailers responsibility not the manufacturer and the trader needs to take it up with them. Im going back tomorrow to kick the managers *****.

Hi, just hoping someone could help me. I bought a Vacuum Cleaner fron Argos last August, over last month of so, the suction on it has gone, tried new filters and all the usuals but no luck. With previous experiance, I took it back to Argos, expecting there would just replace it, I told them the problem, there tested it and found there was a problem. But then the assistant called the manager, and the manager said that I would need to contact Vax the manufacture directly. She pointed to a sticker on the back of the vacuum with Vax's number I said it has a 12 month garuntee with Argos directly and not with Vax. But she replied by sayng that with Vax products I got to contact them, as if there accepted it, there would not get credited from Vax. If this right, in the past, there just replace or replace with another?
