Ouch! Crunched Alloy.

Whilst"kerb crawling" earlier, looking for a clients house I hit a kerbstone which was sticking out, I have alloy wheel cover, but will attempt to claim of the council as the tyre looks pretty badly damaged as well.

sorry to hear of your incident

take pictures maybe have a newspaper present so you can see the date it happened ,use a tape measure to show how far out the kerb stone is protruding,when you get your tyre changed i would ask the tyre fitters if they could write a report on the condition of the tyre just to show the tyre is dangerous to use on the public highway and needed replacing as a matter of urgency.

you will probably have to wait a while for a conclusion.

Ouch indeed...Not wanting to be the bearer of bad news but i suspect you have little comeback against the highways department. My understanding is that the local council have an exemption for liability against damage caused by potholes, kerbstones etc based on their ability to prove that they have a suitable "process" in place for maintaining the highway. Basically this means that so long as they can show that they check the road regularly and it wasn't like it last time they checked they are exempt. If a member of the public reports the issue then they have a "reasonable" period of time to fix the problem. As long as they do that they are covered :-(

My experience and understanding concurs with the above I'm afraid. That and, I suppose, the suggestion that the driver wasn't paying sufficient attention to what's in front of him. Still worth having a go though, if you don't ask you don't get.
