First of all, the description he gave on eBay form terms and conditions of the contract and ure bid is the signature on that contract. So in other words whatever he has described on eBay forms part of a legally binding contract and if any info in there is not true then you have a very good case against him. You dont need any further recipts or proof imo in addition to that. If the mileage isnt correct and as described in the auction then he has broken one of the terms of the contract.

with the mileage being inaccurate imo is a big issue as it makes a big difference to the value of the car. However there is a grey area in this which is whether he knew what the true mileage was. Someone, somewhere has clocked the car back but you have to find out who. I personally think you should find out as much as you can about the car's history and then speak to the guy who sold it to you and try to get the extra money you paid back.

If he doesnt co-operate speak to trading standards and seek their advice.

I looked at my recent BIMTA certificate and this states the mileage on there also. I'm assuming the certificate you have does not show this? That is why you did a mileage check?

I emailed BIMTA and mentioned this situation and they said that you must have an older BIMTA certificate??

This is probably not very helpful but as AltezzaScott said contact BIMTA

well, thats hard but its for you to decide. Think of it this way, what would ure max bid have been if you knew that 186,000 kms was the correct mileage? I would try to get atleast 1k back from him and then see how much he is willing to give back.

Ure not in the wrong obviously so the ball is in ure court and you shud be able to dictate ure terms. you fulfilled the terms and conditions of the contract by paying the cash now its for the other guy to fulfill the terms and conditions. he basically has three options:

1> Provide u with a car that meets the spec that he described in the auction for £7000.

2> Re-imburse you the difference. (This is something u two will have to work out reasonably or you could involve a court to arbitrate or even ebay).

3> Take the car back and re-imburse you with £7000 plus travel expenses e.t.c. for wasting ure time and effort.

Another thing that makes a difference to the price is the fact u pointed out that the car isnt tripatronic.

If you can prove somehow that this guy was responsible for clocking the mileage or he knew the mileage was incorrect then i think u can get him in deep deep trouble. And he wont want this matter to go any further.

who imported the car.........

the milage was changed on entry.......that i am sure of, did the car go via Cyprus

do you know who delt with the car at auction.....i.e which company e.g Bonzaicars etc etc
