Hi everyone,

Just need some opinions,

I sold this phone on ebay: Link

I sold it yesterday to a buyer with 0 feedback, I knew he would pay and it was not a scam as I added buyer requirements such as paypal account required.

He paid immediatly, of which I sent, and he recieved it today.

As you can see from my feedback he left positive feedback at 16:56.

But then at 18:47 he has raised a paypal dispute stating that the screen does not work and wants a full refund.

I have turned this down, and responded by asking him to explain why he left positive feedback 2 hours before the claim, and its clear hes damaged the phone.

but what do you think?

what would Paypal do if its escalated?

see how it goes. i think paypal may support his claim, he can blag them for his reasons for +feedback, any fraudster can set up some paypal account so can never be trusted etc, i think it's best to work with him via e-mail keeping a record to show paypal that you are trying everything to sort out, don't let yourself get angry even though he's taking a liberty, if he is local i would meet to check phone with imei etc, find out how/why/or if phone is damaged (bit dodgy situation i know). or you could roll over and offer full refund and recover handset and don't deal with 0feedback again.

It had to be fully charged before use. So I was unable to test until it was fully charged only to discover that it wasn't working. When the charge was completed I turned the phone on and the screen failed to work therefore its faulty and you sold it in this condition. If the phone was in 'very good condition' like you advertise then it should work but it doesn't. If it was working when you sold it then you should contact Royal mail and claim of them for damaging it and then refund my money.

t had to be fully charged? Its not a brand new phone, its a used phone and does not need to be fully charged also it does not take 2 hours to charge ethier, and you are claiming that you left feedback before even testing it, shows your stupidness, quite simply

Return the phone appropriatly, special delivery next day, and once I have recieved it, and reviewed it, I will provide the refund if appropriate.

There is no chance in hell, I will issue the refund before recieving. I also will be asking a shop to inspect the phone who will tell me how the screen came about to stop working. If its found that the phone was damaged whilst in use. No refund will be issued and the phone WILL be sent back.

There is no need to be rude. When purchasing a second hand phone some may still have charge on them, but in this case it was dead. no one said it took two hours to charge, if fact it had been on charged most of the day.

with regard to feedback we were letting you know (the seller Saj Uldinr) that we had received the phone. it was only when it had finished charging that i found the fault. if you look at terms a buyer (myself) may ask for a refund up to 20 days after purchase if there is found to be a problem, for which there clearly is. it has also be pointed out that you have sold and refund a Nokia N95 back in November of 2008 for the same reason, the screen failed. i would therefore ask you to reconsider and refund the money via paypal i will gladly return the Nokia N95 with a faulty screen when this is completed.

I will only refund the money once the phone has been recieved, the case in November the item was sold as faulty as it clearly states and the buyer decided to put a claim against me when he recieved the phone as faulty.

I will only refund the money once I have recieved the phone, thats how it works. I am happy to refund the money if the phone is recieved back to me and the screen is found not to be working and once the shop has inspected it.

I am being reasonable and Paypal will see this.

Ill be able to check when I get it back, as it was slightly damaged on the corner and a bit on the back of the screen when you slide it open, not obvious.

well he's escalated it to paypal, stating that I issued the refund tothe buyer in november and refusing to issue him.

I have commented that I am happy to refund as soon as the item has been recieved.

I also sent him an email stating that Paypal will take till 12th June to look into, and knowing paypal there will take the full time, and its easier and quicker if he just sent it back. se what he says.

Any where I could get the IMEI number for it? might ring Orange up and ask em, as it was a contract phone, but doubt it.

I used to work for t-mobile customer services for 5 years, firstly as stav says search your house for anything to back you up , contact orange customer services by e-mail explain the problem and they may send you proof of ownership, they can see what handset is recorded and used etc, It may be down to paypal to sort this so watch your email content to the guy, even though you're in the right you are possibly making some unwise comments, as paypal are neutral they will probably go with him from the emails you posted so far. He could send you litterally a small brick back in the post and still have "proof" of sending it back to you. As hard as this is, you may have been totally ripped off, the point is, if he had the intention of ripping you off he may have succeded or if royal mail kicked the packet around he maybe a geniune guy feeling cheated by you. Either way be nice and try and resolve with him and you will soon have your answer one way or another, best of luck mate

will hte buyer escalated it to paypal, as he wanted the refund first before sending the item back,

paypal have decided that he to return the item first and then an refund will be issued.

Of which I have been saying from the start lol see what i can back

Damn sorry to hear that mate, not good at all, but what happens if he does now send it back but he's broken it? Where do you stand, do you still have to issue a refund?

I think that because he has given you postive feedback then that should be the end of the matter.

No one gives feedback if the item is not the same as the listing, unless there a total loser.

The only other factor is was it broken in transit?

I would of not even allowed it to be returned as you now will have the phone and he can refuse redelivery.

not sure what you meant by stating that its the end of it cause hes left feedback.

so far paypal has favoured him, hes going to send it back, plus paypal have put my account in minus of the amount i bought it at, so there able to take the money from my bank account if i dont coperate

right, this is getting very annoying,

paypal had stated that that there would refund the money as soon as the item has been confirmed delivered, ethier by me on the website of by Paypal themself.

Today I checked roymails website with ref number: DW788356181GB

if you check it, it states confirmed delivery by there office today.

Well guess what no sign of it, asked all family members nothing at all.

Rang royal mail as the signature will not appear, and there stated the surname signature was just a scribble starting with "Ba" and the place where you print your name its just "Ba", no one in family is even close to that, and none of the neighbours I know has such a signature.

Fourtunally, I rang paypal explained to the nice english lady (not indian lol who cants seem to understand) and she was very nice and professional and stated if this is case, the refund will not take place, even though royal mail have confirmed it.

She said she will email the buyer and get him to confirm to them the address it was sent and email me, to let me know to call them to discuss further.

this is getting from bad to worse....

I am very tempted to ring both of my banks on my paypal account, and ask them whether there can completly restrict 100% all ingoing and outgoings to paypal.

Is this possible?
